Sri Vivek Verma, learned counsel for the respondents has pointed out Rule 36 (2) of U.P. Nagar Mahapalika Sewa Niyamawali, 1962.
The petitioner being a class IV employee can file an appeal or representation against an order passed by the Nagar Ayukt to the Commissioner of the Division.
Accordingly, this writ petition is disposed of with a direction to the petitioner to approach the Appellate Authority i.e. the Commissioner of the Division against the order of punishment passed by the Nagar Ayukt within a period of three weeks from today.
In case such an appeal or representation is filed, the Commissioner / Appellate Authority shall consider and decide the same on merits and not reject the appeal only on the ground of delay.
