Heard the counsel for the petitioner and Shri Rameshwar Prasad Shukla, Advocate, representing the Gaon Sabha.
The present Public Interest Litigation petition has been filed for removing the illegal encroachment over Plot Nos. 63, 98, 62, 48 and 90, which the petitioner alleges to be vested in the Gaon Sabha.
From the records annexed with the writ petition, it appears that Case Nos. 10403802, 10404458, 10404459, 10404460, 10404461, 10404463, 10404451 and 10404462 have been registered in the court of Assistant Collector, Tehsil-Mohamdabad Gohna, District-Mau against the alleged encroachers.
The Assistant Collector, Tehsil-Mohamdabad Gohna, District-Mau, i.e., respondent No. 3 is directed to decide the aforesaid cases within a period of six months from the date a copy of this order is produced before him, if still pending, and in case there is no legal impediment in deciding the aforesaid cases.
With the aforesaid direction, the writ petition is disposed of.
