Heard Sri Vinod Kumar Dwivedi, learned counsel for the applicant and Sri Raj Kumar Gupta, learned counsel for the State and perused the record.
The instant Anticipatory Bail Application has been filed with a prayer to grant anticipatory bail to the applicant- Ram Murat Verma, in Case Crime No. 92 of 2019, under Sections 308, 323, 504 I.P.C., Police Station- Paikolia, District Basti.
Learned counsel for the applicant argued that the applicant has been falsely implicated in the present case. It is argued that the applicant is ill and even in the present case, there is a cross version. The applicant has also received injuries. The applicant has no criminal history as stated in para 33 of the affidavit.
Per contra, learned counsel for the State opposed the prayer for anticipatory bail and argued that the applicant is named in the first information report and there are allegations against him. There are injured persons in the present case. It is argued that co-accused Ram Badan Verma and Manoj Chaudhary, have been granted bail during the pendency of trial after filing their bail application under Section 439 Cr.P.C. It is argued that the applicant is involved in the present case.
After having heard the learned counsel for the parties and perusing the record, it is apparent that the is named in the first information report. There are allegations against the applicant. There are cross-versions of the present case.
Without expressing any opinion on the merits of the case and considering the submission advanced, the nature and gravity of the accusation, I find no good ground for grant of bail to the applicant- Ram Murat Verma, involved in Case Crime No. 92 of 2019, under Sections 308, 323, 504 I.P.C., Police Station- Paikolia, District Basti.
Accordingly, the anticipatory bail application is rejected.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad.
The computer generated copy of such order shall be self attested by the counsel of the party concerned.
The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
