Heard the learned counsel for the petitioners and the learned standing counsel.
The petitioners who are five in numbers were appointed as Assistant Teacher on 25.1.1991 in Gandhi Smarak Higher Secondary School, Natthupur Lodhana, Ambedkarnagar College which is under the grant-in-aid and is covered under the provisions of payment of salaries Act 1971. The District Inspector of Schools accorded approval on 11.1.1994.
The petitioners were not being paid salary inspite approval of District Inspector of Schools. The petitioner approached this Court and vide interim order dated 21.5.1999 this Court directed the respondents to pay the salary of the petitioners on the post of Assistant Teacher and arrears of salary. The petitioner states that on the strength of the interim order, the petitioners have continued in service and are getting the salary from the Institution and vide order dated 22.8.2012, the services of the petitioners have since been regularized. The order dated 22.8.2012 has been produced by the learned counsel for the petitioners. No counter affidavit has been filed by the respondents.
Since the service of the petitioners have been regularized, no cause survives in the present writ petition.
The writ petition is dismissed as infructuous. It is made clear that dismissal of the writ petition shall not adversely affect the service or regularization of the petitioners on the strength of the interim order.
