Heard learned counsel for applicants and learned A.G.A. for State.
This application under Section 482 Cr.P.C. has been filed with a prayer to direct the learned Chief Judicial Magistrate, Banda to decide /expedite the Case No. 1289/IX/2004 (State Vs. Ram Milan), under Section 409 I.P.C. & Section 29 of Police Regulation Act, P.S.-Kotwali Nagar, District- Banda arising out of Case Crime No. 212 of 2004 within a stipulated period.
It has been contended by learned counsel for applicant that applicant is innocent person and he has been falsely implicated in the present case. It is further contended that the instant proceeding is pending since 2004.
After hearing the learned counsel for the parties and after perusing the material on record, no useful purpose would be served in keeping the application pending which is finally disposed off with a direction to court below to consider and decide the Case No. 1289/IX/2004 (State Vs. Ram Milan), under Section 409 I.P.C. & Section 29 of Police Regulation Act, P.S.-Kotwali Nagar, District- Banda arising out of Case Crime No. 212 of 2004 strictly in accordance with law after hearing the parties and without granting any unnecessary adjournment to either the parties, expeditiously preferably within six month from the date of production of a certified copy of this order before him, provided the proceedings are not stayed by any Court of law.
With the aforesaid direction, the instant application under Section 482 Cr.P.S. is finally disposed of.
