Supplementary affidavit filed by the learned counsel for the applicant today is taken on record.
Heard learned counsel for the applicant and learned AGA for the State.
By means of this application, the applicant who is involved in case crime no. 484 of 2017, under Sections 304 IPC and 4/25 Arms Act, P.S. Shahjanwa, District Gorakhpur, is seeking enlargement on bail during the trial.
Considering the fact that this is one of the rare case where the father has inflicted knife injury blow upon his own son. Though the deceased has died after 15 days during treatment but facts remains that the father is the author of knife injury over the person. The FIR was lodged by none other than wife of the deceased, accordingly the applicant is not entitled to be enlarged on bail at this stage. The bail application of the applicant is hereby rejected.
However considering the peculiar facts and circumstances of the case the trial court is directed to conclude the trial of the applicant within a period of one year from the date of production of certified copy of this order without granting unnecessary adjournments to either of the parties subject to fullest cooperation of the applicant in early disposal of the trial.
Office is directed to communicate this order to the concern court for necessary compliance within fortnight.
