Heard Sri R.L. Dev Vanshi, learned counsel appearing for the appellant on the application seeking leave to appeal against the judgment and order dated 5.6.2018 by means of which the accused-respondent has been acquitted of the offences under sections 307/34 IPC by giving him benefit of doubt.
We have heard learned counsel for the appellant at great length and we have also perused the finding as has been recorded by the court concerned to evaluate as to whether the findings are based on some evidence on record or not.
At the very outset the two of the accused persons, namely, Manoj Kumar, died during pendency of the trial itself and thus the proceedings have been abated by order dated 23.8.2012. Similarly the other co-accused Vijay alias Kallu has also expired and and the proceeding against him has also been abated. At present the Court is concerned only with co- accused Munna-respondent No.2.
We have perused the finding as has been recorded by the trial court and we find that the trial court has very minutely considered, discussed and elaborated upon the evidence that has been produced before the trial court and it is only thereafter the court has given verdict of acquittal. lk{; ls ugha gksrk gS rFkk vfHk;kstu }kjk izLrqr ekSf[kd ,oa vfHkys[kh; lk{; leku :i ls ,d nwljs ls lefFkZr ugha gSA Thus in view of the aforesaid finding the court has concluded hereinasunder:

n.M lafgrk dk vijk/k lkfcr gksus dh i;kZIr lk{; ikdj vkjksi i= izn'kZ d&5 U;k;ky; eas izsf"krA fdUrq vfHk;kstu }kjk izLrqr Lkk{; ls vfHk;kstu i{k vfHk;qDrx.k ds fo:) vkjksfir vijk/k dh ;qfDr&;qDr lansg ls ijs lkfcr djus esa iw.kZr;% vlQy jgk gSA vfHk;kstu lk{;
lansgkLin rFkk vfHk;qDrx.k lansg dk ykHk ikus dk vf/kdkjh gSA nkSjku fopkj.k vfHk;qDrx.k eukst dqekj] fot; mQZ dYyw dh e`R;q gks tkus ds dkj.k muds fo:) ekeyk mi'kfer fd;k tk pqdk gSA rnuqlkj vfHk;qDr eqUuk lansg dk ykHk ikdj nks"keqDr fd;s tkus ;ksX; gSA In view of the aforesaid facts and circumstances of the case, it cannot be said that the view taken by the Court below is not possible and plausible thus the judgment of the court below cannot be interfered with by this Court only on account of the fact that another view is possible.
Thus, in view of aforesaid consistent legal position as elaborated above and also in view of the fact that learned A.G.A. has failed to point out any illegality or perversity with the findings so recorded in the impugned order, no case for interference has been made out.
With regard to the scope of interfernece in an appeal against the acquittal the Apex Court has consistently held:
It is now well settled that the appellate court hearing the appeal against the judgment and order of acquittal will not over rule or otherwise disturb the trial court's acquittal if the appellate court does not finds substantial and compelling reason for doing so. If the trial court's conclusion with regard to the facts is palpably wrong; if the trial court's decision was based on erroneous plea and law; if the trial court judgment is likely to result in grave miscarriage of justice; if the entire approach of the trial court in dealing with the evidence was patently erroneous; if the trial court's judgment was manifestly unjust and unreasonable; and if the trial court has ignored the evidence or misread the material evidence or has ignored material documents like dying declaration/report of ballistic expert etc, the same may be construed as substantial and compelling reason and the first appellate court may interfere in the order of acquittal. However, if the view taken by the trial court while acquitting the accused is one of the possible views under the facts and circumstances of the case, the appellate court generally will not interfere with the order of acquittal, particularly in the absence of aforementioned features.
In the same judgment of the Apex Court the court has relied upon another judgment rendered in the case of Rama Nand Yadav Vs. Prabhu Nath Jha 2003 Volume 12 SCC 606 the relevant paragraph is paragraph 21 whereas in that case the Apex Court has under:
"There is no embargo on the appellate court reviewing the evidence upon which an order of acquittal is based; generally the order of acquittal shall not be interfered with because the presumption of innocence of the accused is further strengthened by the acquittal. The golden thread which runs in the web of administration of justice in criminal cases is that if two views are possible on the evidence adduced in the case, one point to the guilt of the accused and the other to his innocence, the view which is favourable to the accused should be adopted."
The paramount consideration of the court is to ensure that miscarriage of justice is prevented.
"A miscarriage of justice which may arise on the acquittal of guilty is no less then from the conviction of an innocence. In a case when admissible evidence is ignored, and a duty is cast upon the appellate court to reappreciate the evidence in a cae where accused has been acquitted for the purposes of ascertaining as to whether any of the accused commited any offence or not. 2018 volume 7 SCC 219 Jaya Swami Vs.
State of Karnataka.
In the present case learned A.G.A. Though has strongly pressed the application seeking leave to appeal but he has failed to point out any illegality or perversity or misreading of evidence. He has also failed to point out that the view thaken by the trial court is a possible or a plausible view.
Thus, in view of aforesaid consistent legal position as elaborated above and also in view of the fact that learned A.G.A. has failed to point out any illegality or perversity with the findings so recorded in the impugned order, no case for interference has been made out.
It is an established position of law that if the court below has taken a view which is a possible view in a reasonable manner, then the same shall not be interfered with.
After perusal of the impugned judgment shows that the trial court after a thorough marshalling of the facts of the case and a microscopic scrutiny of the evidence on record has held that the prosecution has failed to prove the charge against the accused respondents and the findings recorded by the learned trial judge in the impugned judgment are based upon evidence and supported by cogent reasons.
No interference with the impugned judgment and order of acquittal is warranted. Accordingly leave to appeal is refused and application is rejected. Consequently, the appeal also stands dismissed.
Let the lower court record be sent back to the court concerned forthwith.
Copy of the order be certified to the court concerned for consequential follow up action.
