Heard learned counsel for the applicant,learned A.G.A and perused the record.
This is second bail application of the applicant in case crime No. 337 of 2010,under sections 420,467,468,471,120 B IPC, P.S.Naka Hindola, district Lucknow.
First bail application was dismissed in default on 2.1.2012.
It is submitted that other co accused have already been granted bail. Copy of order dated 22.12.2011 granting bail to co accused Jitendra in bail application No. 592 of 2011 has been filed.
Learned A.G.A has admitted that the role of the other co accused persons is same and no criminal history has been reported against the applicant.
Keeping in view the facts and circumstances of the case, I think it is a fit case for bail.
Let accused applicant Ram Mangal Upadhyay be released on bail in the aforesaid case crime number on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
