Upon some serious charges which may entail, if proved, major penalty the petitioner has been placed under suspension while holding the post of Forest Guard by order dated 25.1.2018.
It is submitted that till date no charge sheet has been served upon the petitioner.
The petitioner cannot be allowed to continue under suspension for indefinite period.
The writ petition is disposed of with the direction that in case the authorities propose to pursue the disciplinary proceeding against the petitioner they shall serve a charge sheet upon the petitioner within 15 days from the date a certified copy of this order is presented before the authority concerned. Thereafter the petitioner will have 15 days' time to furnish his explanation and in case the petitioner furnishes the explanation within the time prescribed the inquiry be concluded within a period of three months thereafter. This order is subject to the condition that the petitioner cooperates in the inquiry. In case even after cooperation of the petitioner if the inquiry is not concluded within the time prescribed, the suspension order dated 25.1.2018 shall automatically be revoked without any fresh order being passed. However, continuance of further inquiry will be at the discretion of the disciplinary authority.
