Heard learned counsel for petitioners and perused the record.
The present petition has been filed by petitioners seeking direction to court below to decide the Original Suit No.896 of 2009 (Phoolchand Vs. Smt. Ram Lakhi Devi and another) pending in the court of Civil Judge (J.D.), Kasia, Kushinagar, within a stipulated period.
It is submitted by learned counsel for petitioners that suit is pending since 2009 and on account of delaying tactics adopted by opposite parties the case could not be proceeded.
Considering the facts and circumstances of the case and without commenting on the merits of the case, learned Civil Judge (J.D.), Kasia, Kushinagar is directed to decide Original Suit No.896 of 2009 (Phoolchand Vs. Smt. Ram Lakhi Devi and another), preferably within a period of one year from the date of production of certified copy of this order, unless there is any legal impediment.
With the aforesaid directions, the petition is disposed of.
