The petitioner, who is one of the plaintiffs in Original Suit No.226 of 2015, filed an application Paper No.9 Ka contending that he had not signed the plaint nor had instructed plaintiff no.2 to file the suit on his behalf. Consequently, the suit be dismissed in so far as it relates to him. The aforesaid application filed by the petitioner has yet not been disposed of and therefore, the instant petition has been filed for a direction to the trial court to decide the said application within a time specified by this Court.
A perusal of the order sheet reveals that the trial court has invited objections on the said application and it is still to be disposed of.
Having regard to these facts, the instant petition is disposed of by directing the trial court to decide the application expeditiously, without granting unnecessary adjournments, preferably within a period of twelve weeks from the date of production of a certified copy of this order.
