When confronted with the observation with respect to the maintainability of the writ petition for relief of mandamus claimed to command the District Authority to restrain private respondents from interfering in the peaceful possession of the petitioner over the property in dispute inasmuch as the administrative authority has no jurisdiction to interfere in civil dispute between the private persons and the remedy available to the petitioner is under the general civil law, learned counsel for the petitioner sought leave of the Court to permit withdrawal of the writ petition and to dismiss the same as not pressed, with the liberty to avail the alternative remedy.
Prayer made is allowed.
The writ petition stands dismissed as not pressed with liberty to the petitioner to avail such other remedy which may be available to him under the general civil law, in case if so advised.
