Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondents.
This writ petition has been filed seeking the following among other relief:-
"i) a writ order or direction in the nature of MANDAMUS commanding and directing the respondent No. 2 to renew the fisheries rights of the petitioner upon Khasra No. 245Ka/ 0.645 hectare situated in Village Banjariya Khanpur, Pargana and Tehsil Bisauli, District Budaun which expire on 14.10.2019 as per the agreement executed in between the petitioner and the concern respondent authorities.
It is settled law that has been held by the Full Bench in the Case of Ram Kumar and is also specifically provided in the Revenue Code, 2006 that a fishery lease shall be granted only for a period of 10 years and that the same shall not be renewable.
Under the circumstances and since the mandamus prayed for, is contrary to law, in this regard, the same cannot be issued.
The writ petition is accordingly dismissed.
