By means of the present petition, the petitioners have questioned the recovery certificate of amount of Rs.11,34,000/- and want that some direction may be issued to the bank to take dues in easy installments.
Learned counsel for the respondent-bank Shri Habib Ahmad has placed before this Court the order dated 15.2.2019 passed in Writ C No.5333 of 2019 filed by the same petitioners and in which the direction was issued for payment of installments but the petitioners have failed to comply with the order.
Learned counsel for the petitioners submits that that writ petition was filed against demand notice whereas this writ petition has been filed against the recovery citation and, therefore, it is clearly maintainable.
I have considered arguments advanced by the counsel for the parties and perused the record.
What I find is that the substantial relief claimed in the present petition is same which was allowed earlier by this Court on 15.2.2019.
In view of Rule 7 of Chapter 22 of the Rules of the Court, second writ petition with same grounds and prayer are clearly not maintainable.
The writ petition is, therefore, dismissed as not maintainable.
