This application under Section 482 Cr.P.C. has been filed for quashing the charge sheet no. 75 of 2015 dated 06.10.2015 arising out of case No. 118 of 2016 in Case Crime No. 461 of 2015, under Section 3/7 Essential Commodities Act, Police Station Mariahun, District Jaunpur.
Charge sheet was filed in 2016 and the cognizance thereafter was taken on 11.02.2016. At this stage, learned counsel for the applicant submits that there is no evidence against the applicant.
Learned A.G.A. has drawn my attention to the extracts of the statement recorded under Section 161 Cr.P.C., wherein, the witnesses had clearly stated that the applicant was misusing the license by not supplying the food grains through the fair price dealership.
Learned counsel for the applicant failed to point out any illegality, infirmity or perversity in the impugned charge sheet.
The application under Section 482 Cr.P.C. is, accordingly, dismissed.
