List has been revised. No one appears for the petitioner. This is a writ petition of the year 2009.
The petitioner in the writ petition is seeking quashing of the order dated 29.8.2009, whereby the previous resolution of the Gaon Sabha passed on 28.8.2009 has been cancelled and a direction has been given to hold a fresh meeting.
On 17.11.2009, this Court had granted time to the learned Standing Counsel to file counter affidavit. In the meantime, the fair price shop licence in question was directed to be not finalized.
Subsequently, the interim order dated 17.11.2009 was vacated by this Court vide order dated 6.5.2011.
A counter affidavit has been filed on behalf of the State- respondents, in which it is stated that a fresh meeting of the Gaon Sabha was held on 26.9.2009 for proposing a name for allotment of fair price shop in the village in question and on the basis of voting, 587 votes were cast in favour of Ram Autar while the petitioner got only 1/3rd votes.
No rejoinder affidavit has been filed till date.
It appears that the petitioner has lost his interest in relief as prayed in the writ petition.
The writ petition is, accordingly, dismissed for want of prosecution.
