Heard learned counsel for the applicants and learned A.G.A. for the State.
This petition under Section 482, Cr.P.C. has been filed for quashing the order dated 17.07.2018 passed by learned Judicial Magistrate, Court No.3, Varanasi in Case No. 105 of 2017, (Nagau Patel Vs. Unknown) under Sections 122­B, 419, 420, 467, 468, 471, 504, 506 IPC in Case Crime No. 64 of 2015, police station Chaubeypur, district Varanasi.
The contention of the learned counsel for the applicants is that no offence against the applicants is disclosed and the present prosecution has been instituted with mala fide intention for the purposes of harassment. He pointed out certain documents and statements in support of his contention. It is further contended that the order impugned has been passed without application of mind and is liable to be quashed.
After hearing the learned counsel for the applicants, learned A.G.A. and after perusing the order impugned as well averments made in the present application, this Court is of the opinion, that learned counsel for the applicants could not point out any legal infirmity in the order impugned which may warrant any interference by this Court in exercise of power conferred under 482 Cr.P.C. jurisdiction.
Accordingly, the application lacks merit and is rejected.
