Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondents.
The instant writ petition is directed against the order dated 24.08.2018, whereby a reference forwarded to the Deputy Director of Consolidation, under Section 48(3) of the U.P. Consolidation of Holdings Act, has been rejected.
The reference was prepared and forwarded to award valuation of a chak out plot, to the petitioner.
The very fact that plot had been left chak out, necessarily means that there was neither any modification or addition thereto, as it was out of proceedings for allotment purposes providing valuation of a plot elsewhere is only required in chak allotment matters and not otherwise.
For the same reason alone, no reference could have been prepared to provide additional or alternative valuation of a plot which was chak out.
The order impugned is therefore, a correct and logical order, which calls for no interference.` The writ petition is therefore, dismissed.
