Heard.
This petition has been filed with the following main prayer:-
"a. issue an order or direction in the appropriate nature commanding the opposite party no.2 to decide the Appeal No.01467/2018; Suresh Chandra Versus Gaon Sabha, through Gram Pradhan, Madanpur, Pargana and Tehsil Fatehpur, District- Barabanki and others, under section 24 (4) of U.P. Revenue Code, 2006, expeditiously, preferably within a period of three months."
It has been submitted that the petitioner and his brother are original tenure holder of certain land situated in Village Madanpur, Pargana and Tehsil Fatehpur, District Barabanki. The nearby gata holders have illegally occupied the land of the petitioner by destroying its boundary and therefore demarcation application was moved which was decided on 21.05.2018 after the order passed by the appropriate authority. The respondent no.3 filed an Appeal against such order which is still pending. The respondent no.3 is resorting to delaying tactics as there is interim order dated 19.06.2018 in the said Appeal.
A copy of the order sheet has been filed as annexure-3 to the writ petition. From a perusal of the same, it appears that only lower court file has been summoned whenever the case was listed before the Additional Commissioner (Judicial) Ayodhya Mandal Ayodhya.
Let the Appeal be decided by the Appellate Authority at the earliest, say, within a period of six months from the date a copy of this order is produced before him.
This petition is disposed of.
