Learned counsel for appellant is not present. Learned A.G.A. for the State is present.
Perused the office report dated 25.10.2021, wherein it is reported that appellant no.1 Ram Kumar and appellant no.2 Man Singh have died. Further perused the report of Chief Judicial Magistrate, Amroha dated 25.8.2021, wherein it appears that learned Chief Judicial Magistrate has conducted the inquiry regarding the death of appellant nos.1 & 2. In this connection, after receiving the report regarding their death, he has also summoned the family members of the deceased Umrao and Kunwarpal and recorded their statements. He has also recorded the statements of Serving Officer S.I. Praveen Kumar and village Pradhan, who have supported the factum that appellant nos.1 & 2 have died.
In view of above, it is proved that appellant no.1 Ram Kumar and appellant no.2 Man Singh have died. Accordingly, the appeal against them is dismissed as abated.
Since the appellants were on bail during pendency of appeal, their bail bonds are cancelled and the sureties are discharged.
Lower court record be sent back to the concerned court.
