Heard learned counsel for the applicant, learned counsel for O.P. No.2 and learned A.G.A.
By means of this application the applicant has challenged the order dated 20.9.2017 passed by Special Judge (Essential Commodities Act)/Additional District and Sessions Judge Ghaziabad in special Complaint case no. 35 of 2007, under section 135 of Electricity Act P.S. Murad Nagar, District Ghaziabad by which N.B.W. has been issued against the applicant.
On perusal of record, it appears that the summoning order had been issued against the applicant on 17.5.2007, however, despite lapse of more than twelve years the applicant has not appeared before court below and as such N.B.W. has been issued against him. The impugned order passed by court below does not suffer from any illegality.
The application filed under section 482 Cr.P.C. is devoid of merit and is accordingly dismissed.
However, it is directed that if the applicant appears and surrenders before the court and applies for bail his prayer for bail shall be considered and decided expeditiously.
