JUDGMENT / ORDER

Heard learned counsel for the applicant and the learned AGA and perused the record.
The learned counsel for the applicant submitted that as per the allegations made in the FIR the dispute is of civil nature and relates to the recovery of certain amount alleged to be payable by the applicant.
Notice on behalf of respondent no.1 has been accepted by the learned AGA. Issue notice to respondent no.2 by registered post for which necessary steps may be taken within two days.
Counter affidavit if any may be filed within four weeks and rejoinder affidavit, if any, within two weeks thereafter.
List immediately after expiry of the aforesaid period.
Till the next date of listing no coercive process shall be issued and executed against the applicant Ram Kumar Singh alias Munnu Singh in Case No. 662 of 2002 (State v Ram Kumar Singh) arising out of Case Crime No. 276 of 2001, under sections 406, 504, 506 IPC, P.S. Maurawan, District Unnao pending in the court of the Civil Judge (Junior Division)/Judicial Magistrate, Purwa, District Unnao.
