Heard learned counsel for the petitioner, learned Standing Counsel appearing for the State- respondent no.1 and Sri Shashank Tripathi, Advocate holding brief of Sri Suman Kumar Yadav, learned counsel appearing for respondents no.2 and 3.
The petitioner claims to be tenant of a shop situated at House No. 92 Thakur Complex Karrahi Road Barra, District Kanpur Nagar since 10.3.1995. The petitioner was using electricity from the connection of the landlord.
It appears that some dispute has arisen between the petitioner and the landlord and his connection has been disconnected by the landlord. The petitioner has applied for fresh connection from the Kanpur Electricity Supply Company(KESCO) but the connection has not been given to the petitioner so far.
Sri Shashank Tripathi, Advocate holding brief of Sri Suman Kumar Yadav, learned counsel appearing for the Kanpur Electricity Supply Company- respondents no.2 and 3 submits that the dispute is with the landlord and the landlord has not been made a party.
We have considered the submissions of the learned counsel for the parties.
In our view the appropriate authority to look into the present controversy is the Executive Engineer- respondent no.3, before whom the petitioner may make a representation and if such a representation is made, the same shall be considered and decided by respondent no.3, as far as possible, within a period of one month from the date a certified copy of this order along with a fresh representation is presented before the authority concerned.
With the aforesaid observation/direction, the writ petition stands finally disposed of.
