Heard learned counsel for the applicants and learned AGA for the State.
This application under Section 482 Cr.P.C. has been filed to quash the charge sheet dated 27.06.2019 as well as entire proceedings of Case No.1905 of 2019 (State Vs. Ram Kailash & others), under Sections 452, 323, 504, 506, 354-Ka I.P.C., arising out of Case Crime No.04 of 2019, Police Station Holagarh, District Allahabad (Prayagraj) and also cognizance order dated 30.07.2019, pending in the court of Additional Chief Judicial Magistrate -5th, Allahabad (Prayagraj).
Learned counsel for the applicants submits that the FIRs have been lodged from both the sides and applicants have been falsely implicated under the alleged sections.
In view of the above, the applicants are permitted to move discharge application through counsel before the trial court within one month from today and the trial court shall decide the same within a period of two months from the date of filing of application alongwith a certified copy of this order.
Till the discharge application is decided, no coercive measures shall be taken against the applicants.
With the aforesaid direction, the application stands disposed of.
