R.N. Shukla, learned counsel for the petitioner and Mr. Pradeep Kr. Tripathi, learned Standing Counsel for respondents-State.
Counsel for respondents, on instructions, submits that the District Magistrate has already issued a notice dated 26.5.2018 asking the private respondent to show cause as to why their mining lease be not canceled. He submits that after receiving the reply, the District Magistrate shall take the notice to its logical conclusion within a period of six weeks from today. His submission is recorded and accepted.
In view thereof, nothing further survives in the writ petition. The petition is, accordingly, disposed of. It is open to the petitioner to seek intervention before the District Magistrate or challenge the order that will be passed by the District Magistrate on the show cause notice, if for any reason, he feels aggrieved.
