1. Ram Krishan Jaiswal, son of Late Mathura Prasad Jaiswal has preferred this petition for issuance of a writ in the nature of mandamus directing respondents to pay compensation for 27 Biswa land comprised in gata no. 335, 336 measuring 54 biswa situated in village Chand Sarai (Mohanlalaganj) District Lucknow which has been acquired for the purposes of Samajvadi Purvanchal Express Way Project.
2. On going through the pleadings in the petition and hearing learned counsel for the petitioner it becomes undisputed fact that in regard to certain land allegedly owned by the petitioner there is a dispute with co-owners which is pending adjudication before the appropriate authorities. It appears that dispute is in regard to apportionment of compensation. It further appears that the respondents have already issued notice to the co-sharers for the compensation wrongly released in their favour.
3. However, it is not disputed that claim of the petitioner for compensation for some of the land is not disputed.
4. Learned counsel for the petitioner contends that the petitioner would contest for his rights before appropriate authorities. The respondents however be directed to release payment for the land acquired that belongs to the petitioner, and is not disputed.
5. Shri R.B.Singh, learned counsel for the State has informed the court that on executing the sale deed undisputed amount would be released in favour of the petitioner.
6. With the above observation, the petition is disposed of.
