Order on Parole Application No.5 of 2021 Heard Sri Mohd. Moonis, holding brief of Sri Qazi Vakil Ahmad, learned counsel for the applicant as well as learned A.G.A. for the State through video conferencing.
The instant application has been filed on behalf of the applicant with prayer to release the applicant on parole / short term bail from 8.5.2021 to 8.6.2021 in Case Crime No. 102 of 2016, under Sections 147, 148, 149, 302, 323, 504, 506, 427, 34 IPC, Police Station Khampar, District Deoria.
It is submitted by learned counsel for the applicant that although fourth bail application of the applicant is pending before this Court and he is languishing in jail since 14.6.2016, yet marriage of the daughter of the applicant namely, Anisha is to be solemnized on 14.5.2021. Presence of the applicant at the time of marriage is necessary to attend the ceremonies like kanyadaan, etc. as per Hindu Rites and Rituals, hence applicant may be permitted to participate in the marriage ceremony of his daughter in police custody.
Learned A.G.A. opposed the prayer.
Keeping in view the facts and circumstances of the case, hearing the parties and going through the record as well as in the interest of justice, parole application is allowed to the extent that applicant is permitted to participate in the marriage ceremony of his daughter on 14.5.2021. Applicant shall be taken from the jail concerned in the morning of 14.5.2021 in police custody to the place of marriage ceremony and shall be sent back / lodged on 15.5.2021 at about 11:00 A.M. in the jail concerned.
Information to this effect shall also be sent to this Court by the concerned authorities after compliance.
Learned counsel for the applicant is hereby directed to download the copy of this order from the official website of the High Court, Allahabad and same shall be furnished before the Chief Judicial Magistrate concerned today itself, who in-turn, will verify the same immediately and will direct the concerned jail authorities to comply the order. Chief Judicial Magistrate concerned is also hereby directed to inform the S.S.P. / S.P. concerned for providing police personnel.
