Heard learned counsel for the petitioner.
This writ petition has been filed seeking the following relief:-
"(I) Issue a writ order or direction in the nature of mandamus commanding the respondent No. 2 to decide the case no. T 2015/4360/469 Year 2014-2015 Ram Kripal Versus Smt. nanhaki and other U/s 229-B, of U.P. Z and L.R. Act with in specific period fixed by this Hon'ble Court or to show cause."
It has been submitted that a suit for declaration under Section 229-B of the U.P. Zamindari Abolition and Land Reforms Act filed by the petitioner has not been disposed of till date.
From the order sheet of the proceedings filed on record or from the submissions made by counsel for the petitioner, it is not clear as to the stage at which suit aforesaid is pending. It is also not clear as to whether the parties have been served and or issues framed in the suit.
In the absence of such information, this court does not consider it expedient to specify a time frame for the decision of the suit.
The writ petition is disposed of with the observation that the trial court should endeavour to decide the suit as expeditiously as possible.
