An application was submitted by the petitioner for construction of Barat Ghar at the land bearing Khasra No. 915(M) measuring 0.9007 hectares situated at Village Noornagar, Pargana-Loni, District-Ghaziabad.
Though the application was submitted on 22.08.2017, the same has yet not been considered and decided. Aggrieved by the same, instant petition for writ is preferred.
From perusal of the facts stated in the petition for writ and the documents annexed thereto, it appears that for grant of approval, a special sanction is required from the Construction Authority Board and that has yet not been availed.
Be that as it may, it is the responsibility of the respondents to act diligently and to decide the application submitted for raising construction.
We do not find any just reason available to keep an application for construction of Barat Ghar for a period more than one year. Accordingly, this petition for writ is allowed. Respondent nos. 2 and 3 are directed to consider and decide the application submitted by the petitioner dated 22.08.2017 in accordance with law expeditiously on or before 01st December, 2018.
