Ram Kripal & Ors. vs State Of U.P. Thru Prin. Secretary ...

High Court Of Judicature at Allahabad|11 February, 2021

JUDGMENT / ORDER

Hon'ble Rajeev Singh,J.
Heard Shri Chandra Bhanu Singh, learned counsel for the petitioners, Shri Anurag Verma, learned A.G.A. for the State and perused the material brought on record.
This petition has been filed seeking a mandamus commanding the respondent no. 3 not to harass or torture the petitioners or the family members, as neither any F.I.R. nor any complaint is registered against them.
It has been argued by the learned counsel for the petitioners that the petitioners, who are the Agents of a Finance Company, namely, Credible Agro and Land Limited, made complaint to the police against the Company and its officials. It is further submitted that earlier an F.I.R. bearing Case Crime No. 359 of 2019, under Sections 406, 420 was also lodged by one Agent, namely, Brij Lal against the Company and when the investigation was not being conducted properly, he approached this Court by means of Writ Petition (M/B) No. 7087 of 2020, in which, a coordinate Bench of this Court vide order dated 06.03.2020 granted time to the learned A.G.A. to file counter affidavit and the matter is sub-judice. Learned counsel for the petitioners also submits that the police, in place of taking any action against the Company, is harassing the petitioners, on account of lodging of the aforesaid complaint by the petitioners against the Company.
Learned A.G.A., on the other hand, submits that the F.I.R. has already been registered for the offences in question against the Company and its officials and the petitioners have come up before this Court with the aforesaid prayer, apprehending their implication in the present case. It is, thus, submitted that this petition is liable to be dismissed.
Considering the facts and circumstances of the case and the submissions advanced by learned counsel for the parties, we are not inclined to interfere in the matter.
The writ petition, accordingly, stands dismissed with the liberty to the petitioners to avail such other remedy, as may be available to them under law.
