Petitioner claims to be the senior most teacher in M.L.D. Adarsh Sanskrit Mahavidyalay, Khudaganj, District Shahjahanpur and is officiating as Principal. His grievance is that although he is continuously working as officiating principal, but the salary admissible to a Principal is being denied to him. This petition accordingly has been filed for a direction upon the authorities to release salary admissible to a regular principal for the period petitioner has been officiating as such.
Sri Ved Byas Mishra, learned counsel appearing for the respondents has invited attention of the Court to Statute 12.22 of the Statute of the Sampurnanand Sanskrit Vishwavidyalaya, which clearly provides that in the event the senior most person is allowed to officiate as Principal, he would only be entitled to the salary of a teacher and not that of a Principal.
Statute is not in issue. The applicability of Statute is also not disputed in view of the fact that the institution is affiliated to Sampurnanand Sanskrit Vishwavidyala, Varanasi. As such, no direction can be issued to consider petitioner's claim, contrary to the provisions of the Statute.
