Heard learned counsel for the parties.
The petitioner is before this Court assailing the order dated 2.5.2018 passed by the second respondent in Revision No.75 of 2016, Computer Case No.C201606000075 (Ram Kishun vs. Kalpana & others) under Section 210 of U.P. Land Revenue Act, 1901 and the order dated 13.1.2016 passed by the third respondent in Case No.75 of 2015, Computer Case No.C20140637021156/14 (Kalpana vs. Prem Narayan) under Section 34 of Land Revenue Act relating to Village Khajuri, Tehsil Moth, District Jhansi. He has also requested to issue direction to the third respondent to connect cases under Section 34 of Land Revenue Act, i.e. Case No.720, 15063702148/2015 (Meera vs. Prem Narayan), Case No.2015063702549 of 2015 (Meera vs. Prem Narayan), Case No.20140637021156/2014 (Kalpana vs. Prem Narayan), Case No.2015063702548/2015 (Om Prakash vs. Prem Narayan) and Case No.2015063702429 of 2015 (Ram Kishun vs. Kalpana Devi).
Once the Court has declined to interfere in the matter, then learned counsel for the petitioner states that even though the request was made before the authority concerned as well as the revisional court that all the proceedings under Section 34 of the Land Revenue Act, which are pending consideration since the year 2016, may be clubbed and decided together expeditiously but at no point of time the said request has been considered by the authority concerned.
Learned Standing Counsel fairly states that in case the aforesaid cases under Section 34 of Land Revenue Act are still pending and have not been disposed of, the same will be considered and decided together expeditiously.
In view of the above, on consent and without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with a direction to the third respondent, Tehsildar, Tehsil Moth, District Jhansi to decide the aforesaid cases under Section 34 of Land Revenue Act together, after giving opportunity of hearing to the private respondents, as expeditiously as possible and preferably within a period of six months from the date of production of a certified copy of this order before him, without granting unnecessary adjournments to either of the parties, except upon payment of cost.
