This revision has been filed against the judgment and order dated 26.2.1980 in criminal appeal no. 313 of 1979 passed by Sessions Judge, Bareilly dismissing the appeal and confirmed the sentence and conviction passed by the First Additional Munsif Magistrate, Bareilly in case no. 140 of 1978 convicted and sentenced to six months rigorous imprisonment and a fine of Rs. 1000/- under Section 7/16 of the Prevention of Food Adulteration Act in default of four months rigorous imprisonment.
List revised. None present for the revisionist. Learned A.G.A. is present.
As per report of the learned C.J.M., dated 27.2.2019 it appears that sole revisionist has died and therefore, this revision is liable to be dismissed as abated.
The impugned order is based on the proper appraisal of the evidence available on record and no interference is required by this Court.
Thus, there is no illegality or impropriety in the impugned order and, therefore, the revision is devoid of merits.
The revision is, accordingly, dismissed. The interim order, if any, stands vacated.
The copy of this order be transmitted to the court below for for necessary compliance.
