Heard counsel for the petitioner.
The writ petition is being filed seeking following relief:
"issue a writ, order or direction in the nature of Mandamus directing the respondent no. 3 to decide the Case No. T2015020304886 of 2015 (Ram Kishore Vs. Chhabbi Devi and others), under Section 176 of U.P. Z.A and L.R. Act within stipulated period as fixed by this Court."
A perusal of the order sheet which has been appended to the writ petition reveals that although the suit for partition had been filed in the year 2015, the issues have not yet been framed. It therefore, follows that the parties are yet to adduce their evidence.
Under the circumstances the writ petition is disposed of directing the trial court to endeavour to deice the suit as expeditiously as possible preferably within a period of 18 months from the date a certified copy of this order is filed before it.
