Heard learned counsel for the applicant and learned Additional Government Advocate for the State/opposite party no.1 and perused the record with the assistance of learned counsel for the parties.
This application under section 482 Cr.P.C. has been filed by the applicant seeking a direction to the concerned court below to decide the protest petition No. 14/12 of 2017 dated 11.09.2017 arising out of Case Crime No. 485 of 2016 (Ram Kishor Prajapati vs State), under sections 498-A, 304-B and 201 IPC and section 3/4 of Dowry Prohibition Act, police station Maudaha, district Hamirpur, expeditiously.
It is submitted by the learned counsel for the applicant that the applicant, who is informant of this case, has lodged first information report dated 05.10.2016 against the accused- persons, in which Investigating Officer submitted final report dated 23.12.2016. Aggrieved by the said final report, the applicant has filed a protest petition dated 11.09.2017, but till date no order has been passed while more than two years have elapsed.
After having heard the arguments of learned counsel for the applicant and learned AGA, this Court feels that no useful purpose would be served in issuing notice to opposite party and keeping this application pending before this Court and it may be disposed of at this stage itself.
Considering the limited grievance of the learned counsel for the applicant, concerned court below is directed to make an endeavour to decide the aforesaid protest petition dated 11.09.2017 in accordance with law, as expeditiously as possible, preferably within a period of thirty days from the date a certified copy of this order is produced before it, if there is no other legal impediment.
With the aforesaid directions, this application is disposed of.
