Learned counsel for the petitioner is permitted to implead the Sub Divisional Officer, Tehsil Sikohabad, District Firozabad as respondent no.3 during the course of the day.
Heard learned counsel for the petitioner and Shri Ashish Kumar Srivastava for the Gaon Sabha as also learned Standing counsel for the State-respondents.
The petition has been filed seeking the following relief-
"i) issue a writ, order or direction in the nature of mandamus commanding the respondents no.1 to decide the misc. suit No.03982 of 2018 (Ram Kishan and others Vs. State of U.P. through Collector and another) within a time bound period, which is still pending before Collector, District Firozabad, otherwise, petitioner shall suffer irreparable loss and injury."
Petitioner is aggrieved on account of pendency of a declaratory suit under Section 144 of the Code, 2006 instituted in the year 2018.
Perusal of the order sheet appended to the writ petition reveals that the issues have not been framed, neither the parties have led their evidence Under the circumstances, this writ petition is disposed of directing the respondent no.1, Collector, District Firozabad to endeavour to decide the suit of the petitioner, expeditiously, preferably within a period of twelve months from the date a certified copy of this order is filed before him.
