Heard counsel for the petitioners and learned Standing counsel.
By means of the present writ petition, the petitioners seek direction in the nature of mandamus commanding the respondent authorities to complete the proceedings for delivery of possession of chaks in the village Aurangabad Tahar Wangar, Pargana Aahar, Tehsil Siyana District Bulandshahar, and conclude the consolidation proceedings.
Contention of learned counsel for the petitioners is that the notification under Section (4) 1 of the Act was issued on 10.4.2000 and the consolidation was completed on 16.5.2016 but till date possession has not been delivered to the concerned chakholders. It is further contended that in this regard representation was filed by the petitioners on 6.4.2019 before the Consolidation Commissioner U.P at Lucknow which remain pending.
In the facts and circumstances of the case, direction is issued upon respondent no.2 Consolidation Commissioner U.P at Lucknow to decide the representation of the petitioners dated 6.4.2019 appended as annexure no. 4 to the writ petition in accordance with law expeditiously, preferably within a period of four months from the date of production of a certified copy of this order.
With the above direction, the writ petition stands finally disposed of. No order as to costs.
