The present petition has been filed by the petitioner to direct the court below to entertain the application under Section 8 (Care and Protection of Children) Act, 2015 regarding the Case Crime No.0444 of 2016, under Sections 354 I.P.C. and 3/4 POCSO Act, P.S. Ughati, District Budaun for determining the age of the applicant through his counsel.
Learned counsel for the petitioner submits that a direction be issued to the court below by which the application of the petitioner may consider and decide by the court below who at the time of incident was juvenile.
Prayer of the petitioner is granted.
Let, petitioner move an application before the court below through his counsel which shall be considered and decided by the court below.
With the aforesaid, the petition is disposed of.
