Heard learned counsel for the petitioner; learned A.G.A. for the respondents 1 and 2; and perused the record.
The instant petition seeks quashing of the first information report dated 26.01.2021 registered as Case Crime No. 45 of 2021 at P.S. Atrauli, District- Aligarh, under Sections 2/3 of U.P. Gangsters & Anti-Social Activities (Prevention) Act, 1986.
The allegation in the impugned first information report is that the petitioner is part of a gang comprising three members, which indulges in anti-social activities such as robbery, theft and other serious offences. The gang chart, annexed at page 27 of the paper book, reflects that, in all, there are seven cases against the gang members whereas, against the petitioner, there are four cases.
In view of the above, no good ground is made out to quash the first information report.
The petition is dismissed without prejudice to the right of the petitioner to apply for bail.
