Heard Shri Kripa Shankar Shukla, learned counsel for the petitioner and Shri Abhisekh Shukla, the learned standing counsel.
This writ petition has been filed for seeking an appropriate direction in the nature of mandamus commanding respondent no.2 to decide petitioner's application dated 30.3.2015 bearing no.D2015166700582, under Section 28 of the U.P. Land Revenue Act within a stipulated period.
Learned Standing Counsel states that no useful purpose would be served by keeping this petition pending and the same be disposed off by giving appropriate direction to the respondent concerned.
This writ petition is disposed off with the direction to respondent no.2 to decide petitioner's application dated 30.3.2015 bearing no.D2015166700582, under Section 28 of the U.P. Land Revenue Act to its logical conclusion as expeditiously as possible in accordance with law preferably within 4 months from the date of production of certified copy of this order.
It is clarified that the proceedings as far as possible should not be repeatedly adjourned, merely on the ground that the Presiding Officer is busy in administrative work.
Service of certified copy of this order upon the respondent concerned shall constitute sufficient notice upon him to submit a compliance report.
The authority concerned shall submit Compliance report in Chambers on 19.9.2018 at 4:00 P.M.
