Heard learned counsel for the petitioner and Shri Sanjay Kumar Singh, learned Addl. Chief Standing Counsel along with Shri Devesh Vikram, learned Standing Counsel for State respondents.
Present writ petition has been preferred assailing the validity of the impugned noting dated 9.8.2020 put up by respondent no.3 and for a direction to respondent no.2 to forthwith provide 'No Dues' as well as Last Pay Certificate (LPC) to the petitioner.
On the matter being taken up on 12.3.2021, the Court has proceeded to pass the following order:-
"Learned counsel for the petitioner on the basis of instructions categorically apprised even though on the basis of the endorsement so made by R.I. Deoria (Paper Book Pg. 22), it is being claimed that wife of the petitioner is residing in the official residence but the same is without any spot inspection of the accommodation in question. The relations of the petitioner with his wife are strain and she is residing with her father as such the impugned noting is liable to be set aside. He further submits that in absence of No Dues and Last Pay Certificate, petitioner is suffering irreparable loss.
Before proceeding in the matter, it would be appropriate let Sri Suryabhan Singh, learned Standing Counsel may obtain necessary instructions in the matter.
Put up this matter on 5.4.2021 as fresh."
In response to the aforesaid order, learned Addl. Chief Standing Counsel, on the basis of instructions, has apprised to the Court that no dues as well as LPC has been issued to the petitioner by the competent authority on 1.4.2021 and as such nothing further survives on this petition.
In view of above, the Court finds that nothing further survives on this petition and the same stands disposed of.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the petitioner alongwith a self attested identity proof of the said person (preferably Aadhar Card) mentioning the mobile number to which the said Aadhar Card is linked.
The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
