Heard learned counsel for the petitioner, Sri Devesh Vikram, learned Standing Counsel for the State-respondent and Shri Ved Byas Mishra, learned counsel appearing for the respondent Nos. 2, 3 & 5.
In pith and substance, petitioner is before this Court with a request commanding the respondent No. 5 to make payment of post retiral dues i.e. gratuity, leave encashment, arrears of salary from month July 2018 to April 2019 alongwith interest on the delayed payment of the post retiral dues in accordance with law within stipulated period.
Learned counsel for the petitioner submits that with regard to the disbursement of the amount, there is no impediment as the objection has already been removed by the petitioner.
Shri V.B. Mishra, learned counsel for the respondents very fairly states that the claim of the petitioner would definitely be looked into and remedied by the authority concerned expeditiously.
In view of the above, on consent and without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally asking the competent authority to look into the grievance of the petitioner strictly in accordance with law within two months from the date of production of a copy of this order. In case the authority concerned came to the conclusion that the claim of the petitioner is sustainable in law, then definitely the payment may be ensured to the petitioner within further two weeks thereafter.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the petitioner alongwith a self attested identity proof of the said person (preferably Aadhar Card) mentioning the mobile number to which the said Aadhar Card is linked.
The concerned Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
