Heard learned counsel for the petitioner and the learned Standing Counsel.
This petition has been preferred seeking the promotion on the post of Sub Inspector in Civil Police.
The consideration of the petitioner's case appears to have been stalled on account of the character roll for the years 2010, 2011 and 2012 having not been completed and placed for consideration before the Board. On the record there exists a communication dated 02 November 2018 in terms of which the S.P. Auraiya has informed the authorities that the recordal of entries for the years in question has been completed.
Learned Standing Counsel however has placed on the record instructions provided by the S.P. Karmik U.P. in which it is disclosed that the character roll entries for the years in question were not received by the Board and it is on this count that the candidature of the petitioner could not be processed. Bearing in mind the aforesaid facts, this petition shall stand disposed of with the following directions:-
The fourth respondent shall ensure that the character roll entries of the petitioner for the years 2010, 2011 and 2012 are duly transmitted to the Board within a period of two weeks from today. Upon receipt of the said records, the Board shall ensure that the candidature of the petitioner for promotion is duly processed in accordance with law and disposed of within a period of one month therefrom.
Since the Court is informed that the petitioner shall be attaining the age of superannuation on 31 December 2018 it is further provided that in case the petitioner is ultimately promoted, he shall be entitled to all consequential benefits.
