Heard learned counsel for the applicant, Sri I.P. Srivastava, the learned A.G.A. for the State and perused the record.
The present bail application has been filed by the applicant in case crime No.1775 of 2013, under Section 302 I.P.C., Police Station Kotwali Orai, District- Jalaun with the prayer to enlarge him on bail.
Although this application has been made for grant of bail, the Court notes that the crime itself was registered in 2013 and since the applicant was absconding, no progress could be made. He ultimately surrendered and was taken into custody on 01 September 2017. In the application, it was categorically averred that the applicant had no previous criminal history. However in the counter affidavit which has been filed, it has been disclosed that during this period yet another case alleging offence under Section 302 I.P.C. came to be registered against the applicant being Case Crime No.62 of 2014. In that matter, the applicant is stated to have been bailed out on 03 April 2018. In that application too, the submission addressed was that the applicant had no criminal history. Bearing in mind the aforesaid fact, the Court finds no ground to enlarge the applicant on bail.
