Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondents The learned counsel for the State is ready for the prayer which has been vehemently objected by the counsel of the petitioner. The petitioner claims that he should be paid compensation in pursuance of the notification no. (Ka.Aaa) 228(A) dated 23.01.2015 as stated in prayer no. 1.
The learned counsel for the State has contended that there is a dispute between the uncle and the petitioner herein and the nephew which involves disputed question of fact that who should be given money.
We would have direct the respondent to decide the matter but because of adamance of the counsel for the petitioner this petition is been taken up for disposal. Grounds A, B, C, D, E will not permit us to pass any mandamus as they are involves highly disputed questions of facts for which no mandamus to be issued when there is a dispute between the inter-se claimants.
The petition is accordingly dismissed.
