Heard learned counsel for the petitioner and Sri Ved Prakas Tripathi for the Gaon Sabha, i.e. respondent No.5, learned Standing Counsel for the respondent Nos.1 to 4 and perused the record.
It is submitted by the learned counsel for the petitioner that Deputy Director of Consolidation, Jaunpur has illegally passed an ex-parte reference order dated 25.06.2020 without giving opportunity of hearing to the petitioners. It is further submitted that against the aforesaid order dated 25.06.2020 a restoration application has been filed by a co-sharer of plot in question. Furthermore, Sahab Lal and others have filed writ petition against the same impugned order dated 25.06.2020, registered a writ-B No.1795 of 2020, in which interim order has already been granted for status quo.
Matter requires consideration.
Issue notice to respondent Nos.6 and 7 returnable at an early date.
List this matter in the week commencing 27.09.2021 along with writ-B No.1795 of 2020, Sahab Lal and 2 others vs. D.D.C. and 4 others.
Till the next date of listing, parties are directed to maintain status quo with regard parcel of land, which is subject matter of instant writ petition.
It is made clear that, in case, any restoration application is pending before D.D.C., same shall be decided on its own merits. The present order will not prevent the hearing of the aforesaid restoration application.
