Heard learned counsel for the petitioner and perused the record.
In view of the order proposed to be passed, notices need not issue to the respondents.
After some arguments counsel for the petitioner confined his prayer only to the effect to direct the Civil Judge (Junior Division), Mau to decide Original Suit No. 35 of 2006 (Balgovind and Others Vs. Nageshwer and Others) within stipulated period.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the Civil Judge (Junior Division), Mau to consider and decide the aforesaid suit in accordance with law expeditiously but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, if there is no legal impediment.
