Heard learned counsel for the applicants, learned counsel for opposite party No.2 and learned A.G.A. for the State.
This application under Section 482 Cr.P.C. has been filed with the prayer to direct learned Courts below to consider and decide bail application of applicants on the same day when their bail application is filed in Sessions Trial No.904 of 2015(State vs. Sanjeev Singh others), arising out of Case Crime No. 129-C of 2014 under Sections 498A, 304-B, 201 IPC and Section 3/4 of D.P. Act, Police Station Behjoi, District Sambhal.
Learned counsel for the applicants submitted that applicants are ladies and have been falsely implicated. Application under Section 156(3) Cr.P.C. against the applicants was allowed which was quashed by the High Court and order of High Court was quashed by the Hon'ble Supreme Court.
A bare reading of the record goes to show that prima facie allegations constitute commission of cognizable offence, hence, there is no reason to interfere in the matter.
The relief claimed in the application by the learned counsel for the applicant is refused.
However, it is observed that in case applicants appear before the court concerned and apply for bail within a period of two months from today. The same shall be disposed of expeditiously by the court concerned in accordance with the law. Till then, no coercive action shall be taken against the applicants.
With the aforesaid observations, the application stands disposed of finally.
