1. Heard learned counsel for the applicant and learned A.G.A. for the State.
2. This anticipatory bail application has been filed on behalf of the applicants Ram Gulam and Rajan Yadav, seeking anticipatory bail in Case Crime No. 375 of 2020, under Sections- 34/120-B, 302, 149, 148, 147 IPC, Police Station - Patherawa, District - Kushinagar during pendency of trial.
3. In view of the direct fact allegation of serious offence has been made against the applicant in the FIR, No ground for anticipatory bail is made out.
4. Learned counsel for the applicant has placed reliance on the order passed in Crl. Misc. Anticipatory Bail Application No.4094 of 2021 dated 25.02.2021. Perusal of the same reveals that the Court has granted time to surrender and appear before the court below. In absence of any statutory scheme, this Court is not inclined to exercise its discretion to grant any such indulgence.
5. Accordingly, the present anticipatory bail application is rejected, leaving it open to the applicants to apply for regular bail, which application when filed may be considered on its own merit as expeditiously as possible, without being prejudiced by any observation made in this order.
