The prayer made in the instant petition is for issuing direction to the trial court to decide the application for temporary injunction pending in Original Suit No.579 of 2019, expeditiously. The petitioner has also made a prayer for directing the parties to maintain status quo, in the meantime.
The suit has been instituted by the petitioner on 15.07.2019. The trial court declined to grant ex parte injunction but issued notices to the defendants, inviting objections against the application for temporary injunction and also granted time to file written statement.
Counsel for the petitioner admits that notice has not been served so far.
Since the order refusing to grant ex parte injunction dated 15.07.2019 is not under challenge, therefore, no case is made out for grant of any injunction by this Court.
However, in the facts of the case, the instant petition is disposed of by directing the trial court to decide the application for temporary injunction, expeditiously, soon after the defendants are duly served.
